Welcome to Cocktail Services Application.

The Application enables users to access a variety of services and communicate with service providers registered on the Application. It also enables service providers to receive customer requests and submit their offers in accordance with the Application's operating mechanism.

By using the Cocktail Services Application, registering on it, or benefiting from any of its services, you acknowledge that you have read, understood, and agreed to comply with these Terms and Conditions.

1. Definitions

The following terms shall have the meanings assigned to them below:

Application: The Cocktail Services application and any related electronic services.

User: Any person who uses or registers on the Application or requests a service through it.

Customer: A User who creates a request to obtain a service.

Service Provider: An individual, establishment, or company that provides services through the Application.

Request: A service request created by the Customer.

Offer: An offer submitted by a Service Provider in response to a Request.

Package: A subscription or package activated by a Service Provider to access the features available within the Application.

Balance: The balance or points available in the Service Provider's Package, which are used in accordance with the Application's operating mechanism.

2. Nature of the Cocktail Services Application

Cocktail Services is an electronic application designed to facilitate access to service providers and connect customers with suitable service providers.

The Application operates as a technological platform for organizing and receiving customer requests and enabling service providers to view requests and submit their offers.

The Application does not itself perform the requested service. The service is performed by the Service Provider selected by the Customer.

The agreement regarding the details, price, appointment, and method of performing the service shall be between the Customer and the Service Provider.

3. Registration and Use of the Application

Individuals and establishments may register on the Application in accordance with the requirements specified during registration.

The User is required to provide accurate, complete, and up-to-date information.

The User is responsible for maintaining the confidentiality of their account information and for preventing any other person from using their account.

It is prohibited to use another person's account, create fake accounts, or use inaccurate information.

The Application reserves the right to suspend or terminate an account in the event of a violation of these Terms or misuse of the Application.

4. Service Requests

The Customer may create a service request through the Application.

The Request may include a description of the service, location, photographs, and other details provided by the Customer.

The Customer is responsible for the accuracy of the information provided in the Request.

The Request will be sent to suitable Service Providers according to the type of service, location, and the Application's operating mechanism.

The Application does not guarantee that the Customer will receive a specific number of offers or that an offer will be received for every Request.

5. Service Provider Offers

Service Providers may view requests relevant to them according to the Application's operating mechanism and submit offers to Customers.

The Service Provider is responsible for the accuracy of the information, price, and details included in their offer.

The Customer may review the available offers and select the offer or Service Provider that best suits their needs.

The appearance or listing of a Service Provider within the Application does not constitute a guarantee by the Application regarding the quality or outcome of the service.

6. Selecting a Service Provider

The Customer has the right to select a Service Provider based on the criteria they consider appropriate, including price, proximity, rating, experience, or other available information.

The Customer should verify the service details, price, and appointment before agreeing to the service.

7. Service Provider Responsibilities

The Service Provider shall:

  • Provide accurate information regarding their identity, business, and services.
  • Provide services in accordance with applicable laws and regulations.
  • Comply with the prices and details provided to the Customer.
  • Perform the service according to the agreement with the Customer.
  • Comply with agreed appointments to the extent possible.
  • Protect Customer information and refrain from misusing it.
  • Refrain from providing any service that violates applicable laws or regulations.
  • Obtain the licenses and permits required for any activity that requires licensing or authorization.
  • Assume responsibility for the services provided to the Customer.

8. Customer Responsibilities

The Customer shall:

  • Provide accurate information when creating a Request.
  • Provide a clear description of the requested service.
  • Provide the correct location when access to the service location is required.
  • Refrain from creating fake or misleading Requests.
  • Refrain from insulting or abusing Service Providers.
  • Comply with the agreement concluded with the Service Provider.
  • Pay the agreed service fee directly to the Service Provider according to the payment method agreed upon by both parties.
  • Refrain from using the Application for any activity that violates applicable laws or regulations.

9. Prices and Payment

The value of the service and its price shall be determined and agreed upon between the Customer and the Service Provider.

Unless expressly stated otherwise by the Application, the Application does not collect service fees on behalf of the Service Provider.

The Service Provider is responsible for clearly explaining all costs associated with the service before performing it.

The Application shall not be responsible for any amounts paid directly between the Customer and the Service Provider.

10. Packages for Service Providers

The Application may provide Service Providers with subscription packages that enable them to access certain services and features within the Application.

The benefits of each Package vary according to the details displayed at the time of subscription.

Subscription to any Package does not guarantee a specific number of customers or requests.

The Service Provider agrees to the terms of the Package before completing the subscription or balance recharge process.

11. Package Balance and Points

The Application may operate using a balance or points system for Service Providers.

The balance or points shall be used in accordance with the applicable Package mechanism.

If a Service Provider selects a Request or satisfies the conditions specified under the Application's system, points or balance may be deducted according to the mechanism disclosed to the Service Provider.

Points or balance shall not be considered cash or monetary value unless expressly stated otherwise by the Application.

12. No Guarantee of Requests for Service Providers

Cocktail Services does not guarantee any Service Provider a specific number of requests or customers.

The receipt of requests depends on various factors, including:

Type of service, location, availability of customer requests, competition among Service Providers, customer selection, Service Provider ratings, and the Application's operating mechanism.

13. No Commission on the Service Value

The Application does not deduct a percentage of the service value agreed upon between the Customer and Service Provider unless otherwise clearly announced.

The service price and payment method are agreed upon directly between the Customer and Service Provider.

The Application is not responsible for collecting payment or guaranteeing payment between the parties.

14. Relationship Between the Customer and Service Provider

After the Customer selects a Service Provider and reaches an agreement with them, responsibility for performing the service and fulfilling the related obligations lies between the Customer and the Service Provider.

The Application does not become a party to the contract or agreement concluded between the Customer and Service Provider.

The Application shall not be responsible for breach of the agreement, delays, failure to perform the service, or differences between the actual service quality and the Customer's expectations.

15. Disputes and Complaints

In the event of a dispute between the Customer and Service Provider, both parties may attempt to resolve the dispute directly.

The Customer or Service Provider may contact the Application's management to submit a complaint or report concerning the use of the Application or conduct that violates the Terms of Use.

The Application has the right to review the complaint and take appropriate action within the Application according to the nature of the case, without this constituting an assumption of responsibility for the performance of the service or the outcome of the dispute.

16. Ratings and Reviews

The Application may allow Users to rate a Service Provider after the service has been performed.

Ratings must be genuine and based on an actual experience.

Fake ratings, defamation, abuse, threats, or publication of personal information about others are prohibited.

The Application reserves the right to remove or hide any rating or content that violates these Terms.

17. Images and Content Submitted by Users

The Application may allow Users to upload images, text, or information related to service requests.

The User is responsible for the content they submit.

The User represents that their use of such content does not infringe the rights or intellectual property rights of others.

Uploading any content that violates applicable laws, public morals, or contains abuse, threats, or unlawful information is prohibited.

18. Communication and Party Information

The Application may allow Customers and Service Providers to communicate with one another for the purpose of fulfilling a Request.

Both parties shall use contact information solely for service-related purposes and shall not misuse or share such information with others without a lawful basis.

The privacy of the other party must be respected, and their information must not be used for harassment or unauthorized marketing.

19. Legal Licenses and Permits

If a service provided by a Service Provider requires a legal license or permit, the Service Provider shall be responsible for obtaining and maintaining the required license or permit.

The Application may not be used to provide services that violate applicable laws or to conduct an activity requiring a license without holding the required license.

20. Prohibited Use

The Application may not be used for:

  • Fraud or attempted fraud.
  • Impersonating others.
  • Providing false or inaccurate information.
  • Creating fake Requests.
  • Misusing the Request or Package systems.
  • Attempting to hack, disrupt, or disable the Application.
  • Publishing content that violates applicable laws.
  • Abusing, threatening, or harassing others.
  • Infringing intellectual property rights.
  • Using the Application for any unlawful activity.

21. Account Suspension or Termination

Cocktail Services reserves the right to suspend or terminate an account or restrict certain services if the User violates these Terms or misuses the Application.

Appropriate action may be taken in cases involving fraud, provision of inaccurate information, harm to other Users, or attempts to circumvent or manipulate the Application's system.

Suspension or termination of an account shall not affect any rights or obligations that arose prior to such suspension or termination.

22. Intellectual Property

All intellectual property rights relating to the Cocktail Services Application, including its name, logo, design, interfaces, software, and content, are owned by the Application or by the respective rights holders or licensors.

No part of the Application may be copied, reproduced, modified, or distributed without prior permission from the relevant rights holder.

23. Application Availability

The Application seeks to provide its services continuously. However, certain services may be temporarily unavailable due to maintenance, updates, technical failures, or circumstances beyond the Application's control.

The Application does not guarantee that all services will be available at all times or in all locations.

24. Limitation of Liability

Cocktail Services makes reasonable efforts to provide an appropriate electronic experience for Users. However, the Application does not guarantee the quality or outcome of services provided by Service Providers.

The Application shall not be responsible for:

  • The quality or standard of the service provided.
  • Delays by the Service Provider.
  • Failure of the Service Provider to attend.
  • Failure to perform the service.
  • Damages resulting from the performance of the service.
  • Prices agreed upon between the Customer and Service Provider.
  • Incorrect information provided by Users.
  • Agreements concluded between Customers and Service Providers.

This shall not exclude or limit any liability or right that cannot legally be excluded or limited under the applicable laws and regulations of the Kingdom of Saudi Arabia.

25. Data Protection and Privacy

The Application processes User data in accordance with the Privacy Policy of the Cocktail Services Application.

The Privacy Policy explains the types of data that may be collected, the purposes for which such data may be used, how it is protected, and the circumstances in which it may be shared when necessary to provide the Application's services.

Use of the Application is subject to the provisions of the applicable Privacy Policy.

26. Amendments to the Terms and Conditions

Cocktail Services reserves the right to amend or update these Terms and Conditions when necessary.

The updated version will be published within the Application or through the website.

Continued use of the Application after the updated Terms have been published constitutes acceptance of the amended Terms and Conditions, to the extent permitted by applicable laws and regulations.

27. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by the applicable laws and regulations of the Kingdom of Saudi Arabia.

In the event of any dispute relating to the use of the Application, the parties shall seek to resolve the dispute amicably. If an amicable resolution cannot be reached, jurisdiction shall lie with the competent authorities in the Kingdom of Saudi Arabia in accordance with the applicable laws and regulations.

28. Contacting the Application Management

For inquiries, complaints, or comments concerning the Cocktail Services Application or its Terms of Use, Users may contact the Application's management through the official communication channels provided within the Application or on the website.

29. Acceptance of the Terms

By using the Cocktail Services Application, creating an account, submitting a Request, submitting an Offer, or subscribing to any Package, the User acknowledges that they have read, understood, and agreed to comply with these Terms and Conditions.
